
Jan and Jason ran a small business. Jan’s two
adult children from her first marriage worked in the business.
Jan and Jason established a self managed superannuation fund. To save
costs, they included Jan’s children as members.
When
Jan died, Jason was prevented from receiving her superannuation
death benefit, even though this was what they had discussed and
agreed.
The
two children held equal voting rights with Jason and demanded
to receive 25% each.
